1. Introduction and Definitions
These terms constitute a legally binding agreement between you ("User", "Advertiser", or "Buyer") and i-Need Classifieds ("we", "us", "our", or "Platform"). We operate as an online classifieds marketplace allowing users to offer, sell, and buy goods and services in South Africa.
2. Compliance with South African Law
By using this platform, you agree to comply with all applicable laws of the Republic of South Africa, including but not limited to:
- The Consumer Protection Act (CPA) No. 68 of 2008: Where applicable, sellers must ensure their listings and sales practices comply with the CPA. As a platform provider, i-Need acts solely as an intermediary and is not a party to the transaction between buyers and sellers.
- The Electronic Communications and Transactions Act (ECTA) No. 25 of 2002: Users must ensure that electronic communications and transactions conducted through our platform comply with ECTA requirements.
- The Protection of Personal Information Act (POPIA) No. 4 of 2013: We are committed to protecting your privacy. The collection, storage, and processing of your personal information are governed by our Privacy Policy, which is fully compliant with POPIA.
3. Role of i-Need Classifieds
i-Need provides an online venue for individuals and businesses to connect. We do not own, sell, or control the items or services listed. We are not involved in the actual transaction between buyers and sellers, and we do not guarantee the quality, safety, or legality of the items advertised, nor the truth or accuracy of the listings.
4. User Conduct and Prohibited Items
When using the platform, you agree NOT to:
- Post false, misleading, defamatory, or fraudulent content.
- Distribute spam, chain letters, or pyramid schemes.
- Harvest or collect information about users, including email addresses, without their consent.
- Post ads for prohibited goods, including but not limited to: illegal drugs, counterfeit goods, stolen property, unlicensed firearms, human parts, or endangered animal products as defined by South African law.
5. Protection of Personal Information (POPIA)
By registering on i-Need or posting an advertisement, you consent to the processing of your personal information for the purpose of facilitating the classifieds service. Sellers may not use a buyer's personal information for any purpose other than completing the specific transaction, unless explicit consent is given by the buyer in accordance with POPIA.
6. Limitation of Liability
To the fullest extent permitted by South African law, i-Need Classifieds and its affiliates, directors, and employees shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our platform, or from any goods or services purchased through the platform.
7. Indemnity
You agree to indemnify and hold i-Need Classifieds harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the rights of a third party.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts.
9. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated revision date. Your continued use of the platform after changes have been posted constitutes your acceptance of the amended terms.
